State government agencies and non-government organisations seeking to share data under the Public Sector (Data Sharing) Act 2016 must complete a data sharing agreement form that outlines how both parties will fulfil the trusted access principles.
The Public Sector (Data Sharing) Act enables South Australian public sector agencies to share data with each other and/or with other trusted entities or non-government organisations under the conditions of individual data sharing agreements. It is recommended to review the Act to ensure you are familiar with your obligations under a data sharing agreement.
Agreements can be between two or more agencies or entities. An agency or entity can be a data provider, a data recipient, or both.
A completed (signed) data sharing agreement must be lodged with ODA in order to meet annual reporting requirements under the Public Sector (Data Sharing) Act. Upon receiving the agreement, a reference number will be issued by ODA.

Government/non-government data sharing agreement
For new agreements between South Australian government agencies and any other non-government entity(ies), (e.g. NGOs, all other tiers of government, councils, industry, research/education sector etc.).
This form must be signed by the Minister for Consumer and Business Affairs, or the minister's delegate, as this is required for agreements with organisations outside of the Government of South Australia.
